Petitioner apprehends arrest in a case registered for the offence punishable under sections 406 of the Indian Penal Code.
It is alleged that the complainant gave Rs. 2,80,000/- through cheque and also gave Rs. 20,000/- cash as a help to the petitioner. After that complainant has given Rs. 11,25,000/- through cheque and cash from 08.12.2016 to 20.05.2019. It is further alleged that altogether Rs. 22,02,477/- has been taken by the petitionerand on demand, he refused to refund the same. It is submitted that petitioner has falsely been implicated in this case. As a matter of fact, this petitioner has
Patna High Court CR. MISC. No.22882 of 2023(2) dt.06-07-2023 2/2 filed one complaint case Number 621 C of 2019 against the informant and in order to save his skin from the aforesaid case of cheque bouunce, this false and concocted case has been lodged. It is further submitted that petitioner has already paid more than Rs. 22 Lac which is evident from the reply of legal notice. So, no offence, as alleged, is made out against the petitioner. Petitioner claims clean antecedent. Learned counsel for the State opposes the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of J.M.
