The petitioner is apprehending his arrest in connection with Muffasil P.S.Case No.121 of 2016 registered for offences punishable under Sections143, 341, 323, 324, 307 an 379 of the Indian Penal Code.

Allegation against the petitioner is about assault by Sword on the informant causing injury to him, however, it is submitted on behalf of the petitioner that as a matter of fact due to trivial issue, the scuffle took place between the parties and the informant received injuries and further the allegation is of assault on the head but the injury is simple in nature.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.16689 of 2017 (2) dt.12-04-2017 2/2 circumstances, as stated above, let the petitioner surrender before the learned court below and make prayer for regular bail, which will be considered by the court below considering the nature of allegation as well as nature of injuries and will pass appropriate order preferably on the same day.

With the aforesaid observation, this application is disposed of.
