JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-10-2018 Heard learned counsel for the petitioner as well as learned Additional Public prosecutor for the State. Earlier, the prayer for bail of the petitioner was twice rejected by this Court but while rejecting the bail prayer of the petitioner vide order dated 17.01.2018 passed in Cr. Misc. No.53818 of 2017, this Court directed the trial court to conclude the trial of the petitioner within six months. Bail order dated 27.09.2018 passed by learned Special Judge, Economic Offences, Patna goes to show that trial of the petitioner is still pending. However, learned counsel for the petitioner submits that accused Sita Nath Sarkar has been granted privilege of bail by

Patna High Court Cr.Misc. No.65377 of 2018 (2) dt.31-10-2018 2/2 a co-ordinate Bench of this court vide order dated 19.09.2018 passed in Cr. Misc. No. 48332 of 2018 and allegedly Rs. 6 lacs counterfeit notes had been recovered from possession of the accused Sita Nath Sarkar and only Rs. 1,98,000/- counterfeit notes are said to have been recovered from possession of the petitioner. Considering the facts and circumstances as well as submission of the parties and also to maintain parity of justice, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Economic Offences, Patna in connection with Complaint Case No. 690( C ) of 2014,subject to the condition that one of the bailors must be a close relative of the petitioner, who shall swear an affidavit as to how he/she is related with the petitioner.
