JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 366 and 366A of the Indian Penal Code. Allegation is that daughter of informant had gone out but did not return. Later on, informant got information that his daughter was seen with petitioner.

It has been submitted on behalf of petitioner that he has got no criminal antecedent. He is in custody since 11.7.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. He has falsely been implicated in the present case. The victim has been examined under Section 164 of the Code of Criminal Procedure in which she has not supported the allegation made in the F.I.R. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

No.50626 of 2016 (2) dt.24-11-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Begusarai, in connection with Phulwaria P.S. Case no. 57 of 2016.
