The petitioner seeks bail in connection with Hajipur Sadar P.S. Case No. 380 of 2022 registered for the offence under Section 394, 307 of the Indian Penal Code and Section 27 of the Arms Act.

The prosecution story in short is that on 20.05.2022 at about 8:30PM, the informant loaded Litchi on pick-up van and was going to Jehanabad fruit market for selling Litchi. When the informant reached near Manua market at about 01:00PM, the pickup was intercepted by a Maruti car and on the gun-point, the miscreants snatched Rs. 7,000/- from the

Patna High Court CR. MISC. No.20597 of 2023(2) dt.22-05-2023 2/3 informant and Rs. 3,000/- from Sadhu Naim Miya. Learned counsel for the petitioner submits that the petitioner is in custody since 12.09.2022 and the petitioner is innocent and has committed no offence and has falsely been implicated in this case and the petitioner is not named in the F.I.R.

Learned A.P.P. has vehemently opposed the prayer for bail of the petitioner and he further submits that the petitioner has seven criminal antecedents.

Considering the criminal antecedents of the petitioner, I am not inclined to grant bail to the petitioner. This application stands rejected.
