2. The petitioner seeks regular bail in connection with Aurai P.S. Case No. 257 of 2022 registered for the offence under Sections 302, 201/34 of the Indian Penal Code.

3. As per the prosecution case, the son of the informant was in love with one Sudha Kumari and used to talk to her on the mobile phone. Two days after the Chhath Festival, he came to Parsama from Ludhiana after the girl called him. After having dinner, he left the house and did not return home. The informant alleges that all the named accused persons, including the petitioner, killed her son.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.21221 of 2026(2) dt.06-04-2026 2/3 petitioner is innocent and has not committed any offence. Petitioner is in custody since 02.12.2025. It is further submitted that a co-accused has been acquitted; therefore, the petitioner deserves bail, as the witnesses have turned hostile.

Learned counsel for the State vehemently opposes the bail application and submits that it has come during investigation that the deceased was called by the petitioner and was subsequently killed because he was in a relationship with Sudha Kumari. He further submits that the petitioner is also an absconder.

6. I have considered the submissions of the parties and have gone through the records of the case. The acquittal of a coaccused is not a ground for grant of bail when the petitioner was an absconder.

7. Considering the aforesaid facts and circumstances and the allegations levelled against the petitioner, this Court is not inclined to grant regular bail to the petitioner.

8. Accordingly, this application for regular bail stands rejected.

9. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations
