The petitioner seeks bail in connection with Giriyak (Katrisarai) P. S. Case No. 193 of 2016 registered under Sections 467, 468, 471, 420 and 120-B of the Indian Penal Code, Section 66C of I.T. Act, 2008, Sections 18(a), 18(b), 18(c), 27(c), 28(a), 27(B), (II), 33 EEC(B), 33(I) of Drugs and Cosmetics Act, 1940 and Sections 3, 4, 5, 7 and 9 of Magic Remedies Act, 1954.

It is contended by the learned counsel for the petitioner that no incriminating article was recovered from the possession of the petitioner. Seized items mentioned in the seizure-list as contained in Annexure-1 to the present

Patna High Court Cr.Misc. No.39581 of 2016 (2) dt.19-09-2016 2/2 application belonged to the petitioner and the seizure of those articles would not attract the ingredients of any offence. It is further contended that the main accused of the case Deepak Kumar has already been granted bail by a co-ordinate Bench of this Court vide order dated 05.09.2016 passed in Cr. Misc. No. 37047 of 2016.

Despite repeated calls none appears on behalf of the State.

Regard being had to the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in Giriyak (Katrisarai) P.
