JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code.
The accusation is of abducting the minor daughter of the informant.
It is submitted by learned counsel for the petitioner that in 164 statement the victim got her age recorded as 22 years whereas the learned court below assessed her age as 21 years, wherein she has stated that she was in love with Amod Yadav since last two to three years, the victim of her own went in the company of Amod Yadav and performed marriage with him. Learned counsel for the petitioner further submits that the informant has
Patna High Court Cr.Misc. No.38201 of 2015 (2) dt.22-09-2015 2/2 not named the petitioner. The petitioner has been roped in the present case since he is relative of the Amod Yadav. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering 164 Cr.P.C. statement of the victim, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bagaha, West Champaran in connection with Bagaha (Bhairoganj) P.S. Case No.595 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
