JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-11-2018 Petitioner prays for bail in connection with Tharthari P.S. Case No. 67 of 2018 registered for the offences punishable under Sections 279, 427 of the Indian Penal Code and Sections 30(a), 38 and 41 of Bihar Prohibition and Excise Act. Allegation against the petitioner is of recovery of 166 litres of foreign liquor and petitioner is not named in the FIR and one mobile phone was also recovered having No.9117327296 and it appears that on the basis of that mobile petitioner has been made accused in this case. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and the recovered mobile is not of the petitioner, rather mobile number of petitioner is 9117327496 and he is in custody since 15.9.2018. Heard learned APP also.
