JUSTICE SUDHIR SINGH ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 366A and 494 of the Indian Penal Code. Allegation against petitioner is that he had abducted minor daughter of informant and solemnized marriage with her. On protest by informant, attempt was made to assault him. It has been submitted on behalf of the petitioner that he is in custody since 25.11.2015. Chargesheet has been submitted against petitioner. Petitioner has got no criminal antecedent. He is named in the F.I.R. He has falsely been implicated in the present case. The medical examination report does not support the allegation made in the F.I.R. There was previous love affair between the victim and petitioner.

On behalf of the State, it is submitted that petitioner is named in the F.I.R. The victim is minor. The victim has been examined under Section 164 of the Code of Criminal Procedure where she has alleged of her sexual abuse by petitioner.

Patna High Court Cr.Misc. No.50311 of 2016 (3) dt.15-12-2016 2/2 Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner at this stage, same is rejected.
