JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 19-07-2017 Prayer for anticipatory bail to the petitioner, who happens to be the father-in-law of the deceased, was earlier refused by this Court on 26.5.2008.
Petitioner submits that the husband and mother-in-law of the deceased has been acquitted in Sessions Trial No. 747 of 2009 and 364 of 2011, respectively The aforesaid plea cannot be a ground for seeking privilege of anticipatory bail as the petitioner avoided the process of the court since 2008, let the petitioner surrender and seek regular bail which would be disposed of, preferably on the same, on its own merit without prejudice.
The bail petition is dismissed.
