Petitioner seek bail in Piribazar P.S. Case No. 67 of 2014 registered for the offence punishable under Section 394 of the Indian Penal Code.

Allegation against the petitioner is for causing assault on the head of the informant, as a result of which he sustained injury and also took away his motorcycle and against the coaccused, there is allegation of snatching mobile and money from the informant.

It has been submitted on behalf of the petitioner that he has been falsely implicated in this case due to dirty village politics. For the alleged incident of 18.09.2014, F.I.R. has been instituted on 20.09.2014, after a delay of two days. Except

Patna High Court Cr.Misc. No.67844 of 2018(2) dt.28-11-2018 2/2 suspicion, there is nothing against him. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has no criminal incident and he is in custody since 27.04.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner, named above, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Lakhisarai in connection with Piribazar P.S. Case No. 67 of 2014 with following conditions:- (I) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioners shall co-operative in the trial and shall be represented on each and every date fixed by the Court.

(3) If the petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners. (S. Kumar, J) sushma/- U T
