2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act.

3 . It is alleged that 960 liters spirit was recovered from hut of co-accused Ram Niwas Singh .

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of confessional statement of co-accused Ram Niwas Singh . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . Petitioner has got 1 criminal antecedent of similar nature .

Considering the aforesaid facts and other circumstances of case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive special Excie Court No. 3 Civil Court East Champaran at Motihari in connection with Kalyanpur Police Station Case No. 448 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023 .
