Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner is in custody since 15.10.2016. Petitioner is main assailant according to eyewitnesses.
Earlier prayer for bail was refused on 06.03.2018 vide Annexure-1 with direction to the trial Judge to conclude the trial preferably within nine months, failing which liberty was allowed to the petitioner to renew his prayer for bail before the trial Judge itself.
The impugned order as well as report of the learned trial Judge dated 30th April, 2019 reveals that during course of prosecution evidence, a petition under Section 319 Cr.P.C. was
Patna High Court CR. MISC. No.19730 of 2019(3) dt.08-05-2019 2/2 filed by the prosecution and one Akhil Singh was summoned to face trial.
In view of the aforesaid situation, the trial is not likely to conclude in near future, hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr. No. 266 of 2017 arising out of Shahpur Police Station Case No. 201 of 2016, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
