JUSTICE SUDHIR SINGH ORAL ORDER 08-12-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. Allegation against petitioners along with other accused persons is of causing fire arm injuries against one Pramod Yadav, who succumbed to his injuries.

It has been submitted on behalf of petitioners that they are in custody since 6.9.2016. Chargesheet has been submitted against petitioners. No allegation of tampering of witnesses is alleged against petitioners. As per F.I.R. petitioners were seen fleeing away along with other accused persons from the place of occurrence. No specific allegation has been made against petitioners. There is no eye witness to the alleged occurrence. On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.52592 of 2016 (2) dt.08-12-2016 2/2 above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Bagaha, West Champaran, in connection with Ram Nagar P.S.
