2. The accused/petitioner is named in the FIR and apprehending his arrest in connection with Sandesh P.S. Case No.233 of 2024 registered under Sections 310(2), 311, 109 of the Bhartiya Nyaya Sanhita, 2023 (in short 'B.N.S.') and Section 27 of the Arms Act.

3. Allegation against the petitioner is to commit dacoity along with other co-accused persons and while committing so, looted cash of Rs.9,40,000/- along with Laptop and printer, which was in possession of the informant. During the course of dacoity, the firearm injury was caused to informant and others.

It is submitted by learned counsel that no overt act appears attributed during the course of occurrence by petitioner and same also not appears out of confessional statement of the co-accused namely, Srikant @ Srikant Mahto. It is also pointed out that during the course of investigation, no injury was found as alleged. The petitioner claimed to be a man of clean antecedent.

5. Learned APP while opposing the prayer of anticipatory bail submitted that the petitioner is a named accused, as he was identified from the C.C.T.V. footage. It is submitted that involvement of petitioner was also supported by co-accused Srikant @ Srikant Mahto, who also appears visualized out of same C.C.T.V. footage. Learned APP further submitted that during the course of occurrence, two persons were received bullet injuries and cash of Rs. 9,40,000/- was looted by the accused persons including petitioner. It is submitted that the offence is of heinous in nature for which investigation is still open.

6. In view of aforesaid factual submissions and by taking note of nature of accusation, where petitioner appears
