JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2018 The petitioner seeks regular bail in connection with Kalyanpur P.S. Case No. 75 of 2018, registered for offences punishable under Section 392 of the Indian Penal Code. Allegation as per F.I.R. is that four unknown persons had intercepted the motorcycle of the informant and on the gun point, they looted cash of Rs.78,000/-, 60 gram gold, 1 kilogram silver, mobile phone and motorcycle.

Submission of learned counsel for the petitioner is that the petitioner is not named in the F.I.R. and nothing has been recovered from his possession and he is not put on T.I.P. Further submission is that though he is accused in six other cases, but he is on bail in most of the cases and he is in judicial custody since 30.06.2018.

No.67129 of 2018(2) dt.27-11-2018 2/2 Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, in connection with Kalyanpur P.S. Case No. 75 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
