JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Darbhanga (Sadar) P.S. Case No. 237 of 2015 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
Dead body of sister of the informant was recovered and thereafter he lodged the case stating that the deceased, who was wife of the petitioner, had strained relationship with her husband and as such she filed a maintenance case and it is alleged that petitioner has killed the deceased and thrown her dead body. It further appears that the case is of the year 2015. Submission of learned counsel for the petitioner is that he was not present at that time, rather he was at Delhi and as such he has falsely been implicated at the instance of the
Patna High Court CR. MISC. No.22735 of 2019(4) dt.21-06-2019 2/2 informant.
Heard learned APP also.
In view of above facts and circumstances and considering the conduct of the accused petitioner, I am not inclined to grant the privilege of anticipatory bail. He may surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order. With the above observation, this application is dismissed.
