2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341 , 323 , 324, 325 , 307, 504 and 34 of the Indian Penal Code .

3. As per the prosecution case , on 28.11.2023 at about 9:00 AM, while the informant was sitting at his house , meanwhile all the F.I.R., named accused persons including these petitioners armed with lathi and danda came there and assaulted informant and his wife .

4. It is submitted on behalf of the petitioners that both parties are co-villagers and due to land dispute an altercation

Patna High Court CR. MISC. No.24909 of 2024(5) dt.14-08-2024 2/2 took place between them in which both sides sustained injuries. Case and counter case . Injury allegedly caused by these petitioners is found to be simple in nature . Petitioners claim clean antecedent.

5. Learned counsel for the State opposed the bail petition .

6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the ACJM II Saran at Chapra in connection with Dighwara P.S. Case No. 405 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure . (Prabhat Kumar Singh, J) Koushik/- U T
