JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2019 Petitioners seeks bail in anticipation of their arrest in connection with Bithan P.S. Case No. 99 of 2018 registered for the offences punishable under Sections 363, 364 and 120B of the Indian Penal Code.

Prosecution story is that son of the informant had gone by motorcycle and thereafter he was traceless and later on his dead body was recovered and it is suspected that son of the deceased had illicit relationship with the sister of the petitioners and he had gone to meet her and he has been killed by the petitioners and other accused persons.

Submission of learned counsel for the petitioners is that except suspicion there is absolutely nothing against the

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Rosera, Samastipur, in connection with Bithan P.S. Case No. 99 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioners have to co-operate in the investigation and appear before the I.O. as and when required, otherwise bail bonds of the petitioners shall be cancelled.
