Petitioners apprehend their arrest in Muzaffarpur Complaint Case No.852 of 2018 registered under Sections 498(A), 323 and 506 of the Indian Penal Code and under Section 3 and 4 of the Dowry Prohibition Act. The complainant made allegation that on account of non-fulfillment of additional demand of dowry her husband and other in-laws subjected her to all sorts of torture. Her husband is an N.R.I. engineer but he did not want to take her to U.S.A. with him.

Learned counsel for the petitioners submits that the

Patna High Court CR. MISC. No.31936 of 2019(2) dt.14-05-2019 2/2 petitioners are brother-in-law, sister-in-law and mother-in-law of the complainant. They have no manner of concern with the family affairs of the complainant and her husband. The complainant is also a qualified woman having decree of M.B.A. No occurrence as alleged by the complainant has ever taken place. The complainant lodged the case making false and frivolous allegation against the petitioners.

Having considered the facts and the nature of allegation made against the petitioners and the fact that the petitioners are brother-in-law, sister-in-law and mother-in-law of the complainant, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., West Muzaffarpur in connection with Complaint Case No.852 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
