The petitioner seeks bail in a case instituted under Sections 212, 213, 214, 215, 216, 217, 218, 221, 225, 225(A), 379, 411, 406 and 120(B) of the Indian Penal Code. The allegation against the accused persons including the petitioner is that he facilitated in the escape of arrested Farooque.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.08.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The other co-accused

Patna High Court Cr.Misc. No.50516 of 2016 (2) dt.22-11-2016 2/2 persons have been granted anticipatory bail vide Cr. Misc. No. 43691 of 2011, Cr. Misc. No. 6337 of 2012, Cr. Misc. No. 4389 of 2014 and Cr. Misc. No. 31134 of 2016 by another co-ordinate Benches of this Court.

On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jhanjharpur, Madhubani in connection with Lakhnour P.S. Case No.50 of 2011, G.R. No. 738 of 2011.
