JUSTICE SANJAY PRIYA ORAL ORDER 04-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 304(B), 201 and 34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that the petitioner is married Nanad. There is general and omnibus allegation against her.
From the written report it appears that the husband of the deceased informed the informant that his daughter died after taking poison. The informant went to the sasural of his daughter where he saw that all the named accused persons were present there and told that his daughter had taken poison after altercation with her husband.
Patna High Court Cr.Misc. No.3292 of 2017 (2) dt.04-02-2017 2/2 In this manner, from the nature of allegation made in the written report itself it appears that no overt act is alleged against the petitioner.
Considering the facts and circumstances of the case, let the petitioner above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Ghoshi P.S. Case No. 274 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
