The petitioner seeks regular bail in connection with Nokha P.S. Case No. 260 of 2017, registered for the offence punishable under Sections 392 of the Indian Penal Code. The allegation is regarding unknown miscreants having stolen the tempo of the informant.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that neither any recovery has been made from the possession of the petitioner nor any Test Identification Prade has been held to connect the petitioner with the alleged crime. Lastly, it is submitted that though the petitioner is accused in 13 cases, but he has been convicted in one case

Patna High Court CR. MISC. No. 19940 of 2019(2) dt.05-04-2019 2/2 and he is on bail in other cases, hence, the petitioner is ready to abide by whatsoever conditions which is thought proper by this Court to be imposed for the purposes of grant of bail. The petitioner is stated to be languishing in custody since 05.02.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sasaram, District-Rohtas in connection with Nokha P.S. Case No. 260 of 2017. It is further directed that the petitioner would mark his attendance before the Officer-in-Charge of the concerned police station at 10:00 am. on each Monday of the week and in the event of two consecutive defaults, the present privilege of the regular bail shall stand cancelled automatically.
