JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 02-08-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 467, 471, 147, 149, 353 of the Indian Penal Code.

As per prosecution case, the petitioner along with three others and 15-20 unknown persons came and obstructed the informant and other officials from discharging their official duties. It is further alleged that during the inspection of the alleged land, it has come to the knowledge of the informant that the petitioner prepared forged document with a view to garb the Government land.

It is further submitted that Sukhdeo Mandal has managed to create Jamabandi in respect of Plot No.1805 and others and the petitioner has no concern with Sukhdeo Mandal and his heirs. The petitioner has clean antecedent as stated at para 3 of the bail petition. The petitioner is in custody since 26.02.2022. Learned A.P.P. for the State has opposed the bail petition of the petitioner by submitting that the petitioner caused hindrance in discharging public duties.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Banka, in connection with Bandhuwa Kurawa P.S. Case No. 15 of 2022.

The application stands allowed.
