JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-09-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the complainant is languishing in jail since 10.06.2016 in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A and 494 of the Indian Penal Code.
The basic accusation is of torture and performing second marriage.
It is submitted by the learned counsel for the petitioner that the petitioner was granted bail on the basis of comprise on the condition of making payment of `3500/- per month to the complainant but since the petitioner could not comply the terms of
Patna High Court Cr.Misc. No.39164 of 2016 (2) dt.07-09-2016 2/2 compromise, the bail bonds of the petitioner were cancelled. Considering the nature of accusation and period under custody, let the above named petitioner be released on bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate-III, Sitamarhi in connection with Compliant Case No. C-1/1414 of 2012.
