Petitioner seeks bail in Kadamkuan P.S. Case No. 450 of 2017 registered for the offence punishable under Section 392 and 411 of the IPC and Section 25(1-b)a, 26 and 35 of the Arms Act.

Allegation against the petitioner is of snatching mobile, gold ring and one Splender Plus motorcycle of the informant.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. No incriminating article has been recovered from the possession of the petitioner. Except the confessional statement, nothing is against the petitioner and the confessional statement made before the

Patna High Court Cr.Misc. No.64997 of 2018 (2) dt.20-11-2018 2/2 police, has got no evidentiary value in the eye of law. He is in custody since 22.12.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 7th Patna, in connection with Kadamkuan P.S. Case No. 450 of 2017 with following conditions:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (S. Kumar, J) sushma/- U T
