1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in connection with Kharik P.S. Case No.265/2024, registered for the offences punishable under Sections 105, 319(2), 318(4) and 3(5) of the B.N.S.S. & Section 15(2) of the Indian Medical Act, 1956.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a woman and is in custody since 01.12.2025. It is further submitted that from perusal of the allegation as alleged in the FIR, it would manifest that mother of the informant died on account of operation done by the doctors but then petitioner being a Asha worker came to be implicated with an allegation that it was she, who had advised the informant to take his mother to Vishwakarma Health

Patna High Court CR. MISC. No.20040 of 2026(2) dt.11-05-2026 2/2 Center. It is further submitted that if privilege of bail is granted, the petitioner will not abscond rather will cooperate in the trial to prove her innocence.

4. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, the above-named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kharik P.S. Case No.265 of 2024.

6. Further, one of the bailors of the petitioner shall be her husband, namely, Sharvan Kumar Das @ Shravan Das.

7. It is made clear that if the learned trial court comes to a conclusion that petitioner after his release is trying to delay the framing of charge or after framing of charge is trying to delay the trial, in both the conditions, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
