NILU AGRAWAL ORAL ORDER 13-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner is languishing in judicial custody since 08.08.2016 in connection with Jakkanpur P. S. Case No. 100 of 2015 registered for the offence punishable under Sections 420 and 379 of the Indian Penal Code.
The prosecution case as lodged by the informant is that the petitioner, who is his driver, had taken his Bolero white car for refueling and did not return back, hence, it is alleged that the petitioner must have made a conspiracy to sell the vehicle. It has been submitted by the learned counsel for the petitioner that he is innocent and has falsely been implicated in the aforesaid case and that he has no criminal history and being the

No.51654 of 2016 (2) dt.13-12-2016 2/2 driver of the informant and getting no wages, he decided to leave the informant's service, hence a false case has been registered against him. It is also submitted that the petitioner has surrendered on his own and that charge sheet has already been submitted, hence, there is no chance of tampering with the prosecution evidence.
Learned A.P.P. for the State submits that the petitioner is named in the F.I.R., hence, opposes the prayer for bail.
Be that as it may, since charge sheet has already been submitted, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna in connection with Jakkanpur P.S.Case No. 100 of 2015.
