The petitioners apprehend their arrest in Kudra P.S. case No. 242 of 2016 under Section 414 of the Indian Penal Code and under Section 20 (b) (ii) (B)/27 (A) of the N.D.P.S. Act. The police got information that Ashutosh Pandey @ Bibhu Pandey was dealing in psychotropic substance and on such a raid was conducted at his house and from the house of Ashutosh Pandey 7 kg and 750 gram of Ganja besides laptop and motor cycle was seized. Ashutosh Pandey disclosed that Shashi Shekhar Singh, Chandan and his brother Kush Pandey are his accomplices. The learned counsel for the petitioners submits that save and except confession of the Ashutosh Pandey, from whose
Patna High Court Cr.Misc. No.10478 of 2017 (2) dt.15-03-2017 2/2 possession 7 kg and 750 gm. of Ganja was recovered, there is nothing on record to show that petitioners were involved in selling Ganja. Nothing has been recovered from the possession of the petitioners.
Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge-cum-Sessions Judge, Kaimur at Bhabhua in Kudra P.S. Case No. 242 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
