Petitioner, who is in custody, seeks bail in connection with Samastipur (Rail) P.S. Case No. 177 of 2018 (G.R. No. 804 of 2018) registered for the offences punishable under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is of recovery of 06 liters of liquor beneath his seat when he was travelling in the train.

It has been submitted that petitioner is innocent and has been falsely implicated in this case on suspicion only. Nothing has been recovered from the possession of the

Patna High Court Cr.Misc. No.66666 of 2018(2) dt.22-11-2018 2/2 petitioner. Petitioner has no criminal antecedent and is in custody since 17.08.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-VI- cum-Special Judge, Excise, Samastipur in connection with Samastipur (Rail) P.S. Case No. 177 of 2018 (G.R. No. 804 of 2018).
