JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 15-05-2020 Heard Mr. Surendra Kumar Singh learned counsel for the petitioners and Mr. Ram Priya Sharan Singh, learned additional public prosecutor for the State via video conferencing.

The petitioners have filed the present application under Sections 439 and 440 of the Code of Criminal Procedure for grant of bail in connection with Special (Excise) Case No. 494 of 2020 arising out of Shahpur P.S.Case No. 65 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Considering that for the alleged recovery of 80 litres of mahua wine from a tempo of which the petitioners are

No.19095 of 2020(2) dt.15-05-2020 2/2 two out of the seven occupants and are in custody since 08.03.2020, they are directed to be released on bail on furnishing bail bond of Rs.5,000/- (Rupees five thousand) each with two sureties of the like amount each to the satisfaction of the learned 4th Additional Sessions Judge-cum-Special Judge, Excise, Bhojpur (Arrah) in connection with Special (Excise) Case No. 494 of 2020 arising out of Shahpur P.S.Case No. 65 of 2020.
