JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 2173 of 2015, registered under Sections 323, 498'A', 504 and 506/34 of the Indian Penal Code. Learned counsel for the petitioner submits that, on the joint prayer of learned counsel for the petitioner and the opposite party no. 2, the matter was referred to the Mediation Centre, Patna High Court for settlement of dispute in between the petitioner and the opposite party no. 2, where in spite of best efforts, the dispute could not be settled but now petitioner and the opposite party no. 2

Patna High Court Cr.Misc. No.11067 of 2017 (4) dt.11-09-2017 settled their dispute out side of court and both are leading their conjugal life.

Learned counsel for the opposite party no. 2 has no objection in allowing the prayer for bail of the petitioner and she is residing with the petitioner.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Saran at Chapra, in connection with Complaint Case No. 2173 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
