JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-01-2017 Heard the parties on the application for anticipatory bail filed by the petitioner in connection with Akorhigola P.S.Case No.93 of 2015 for the offence under Sections 414 and 34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the petitioner has himself admitted that he has purchased a Motorcycle from the co-accused, Lal Babu Singh, as such it is a bona fide case of purchase of the stolen Motorcycle. The petitioner is in custody for about four months. It is further submitted that so far other cases is concerned, he has already been acquitted in those cases.

Patna High Court Cr.Misc. No.49345 of 2016 (3) dt.19-01-2017 Having heard both sides. In view of the facts that though there is allegation of recovery of one stolen Motorcycle, which the petitioner has purchased from the co-accused, Lal Babu Singh and the petitioner is in custody for about four months, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Dehri, District- Rohtas in connection with Akorhigola P.S.Case No.93 of 2016 with a condition that one of the bailer should be local one as well as he will co-operate in the trial of the case and make available himself as and when required and if he fails to appear on two consecutive dates, the learned court below may consider for cancellation of the bail bond of the petitioner. With the aforesaid observation, this application is allowed. (Vinod Kumar Sinha, J) chn/- U
