The petitioner apprehends her arrest in Jamo Bazar P.S. Case No. 75/2016, registered for the offences punishable under Sections 366(A), 34 of the Indian Penal Code. The informant alleged that when he woke up in the morning he did not find his daughter. The informant suspected that the petitioner, who happens to be the wife of younger brother of the informant, enticed his daughter for the purpose of marriage with Pappu Kumar driver of J.C.V. vehicle.
Learned counsel for the petitioner submits that the petitioner is innocent and she in fact committed no offence. The informant further alleged that the petitioner earlier enticed the elder daughter of the informant, got her married with the brother
Patna High Court Cr.Misc. No.10483 of 2017 (3) dt.13-04-2017 2/2 of the petitioner, but the informant did not lodge any case. It is further submitted that a partition suit is going on between the husband of the petitioner and the informant and that is why the petitioner has been falsely implicated in the case. The daughter of the informant herself left the house and fled away with Pappu Kumar.
Considering the facts aforesaid and the fact that petitioner is a lady and she is none else than the wife of the younger brother of the informant, the petitioner above-named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Siwan in connection with Jamo Bazar P.S. Case No. 75/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
