JUSTICE ARVIND SRIVASTAVA ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends his arrest in connection with Hilsa P.S. Case No. 289 of 2010 registered under Sections364/34 of the Indian Penal Code. It is alleged that Guddan Mian made a telephone call to the husband of the informant and asked him to come immediately. He went out and did not return. Informant suspected that he might have been kidnapped and killed by Guddan Mian.

Learned counsel for the petitioner submits that petitioner's name has come on suspicion. Petitioner's statement was recorded as a witness in the case. Co-accused persons have

Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that case of the petitioner is different from the co-accused persons who have been granted bail. Victim is still traceless. Charge sheet has already been submitted against accused persons.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the State, I do not feel inclined to grant the privilege of bail to the petitioner. His prayer for bail is, therefore, rejected.
