JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Barari P.S. Case no. 348 of 2016, registered under Sections 341, 323, 379, 307, 504 & 506/34 of the Indian Penal Code. In paragraph No.3 of the petition, the petitioner has stated that there is no criminal antecedent except Complaint Case No. 1711 of 2013 between the same party and the petitioner along with 17 others, who have been made accused and they have been granted bail in the said case. In para-06 of the petition, it has been mentioned that there is land dispute between the parties and there is also a counter case bearing Barari P.S. Case No. 353 of 2016 between the parties arising out of the land dispute. Learned counsel for the petitioner has relied upon Annexure-05 i.e. Injury Report, the injury found on the person of the informant is simple in nature.
