This application is for grant of bail in connection with Imamganj P.S.Case No.87 of 2012 for the offence under Sections 304B, 201 and 34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that earlier a report was called for from the learned court below and from perusal of the said report, it appears that in this case, witnesses have already been examined and the case is pending for evidence of a private witness, Suresh Yadav and the I.O.

Heard learned A.P.P. also.

Having heard both sides and without going into the merit of the case as well as considering the fact that now the case is pending for evidences of one private party and the I.O. and the

Patna High Court Cr.Misc. No.52411 of 2016 (4) dt.20-03-2017 2/2 case has been taken up for speedy trial, I am not inclined to grant bail to the petitioner at this stage, however, the case is pending only for evidences of two witnesses, the learned trial court is directed to expedite the trial and try to conclude it within a period of three months from the date of receipt of this order. Further the S.P., Gaya is directed to get one private witness and the I.O. produced in the court below on the next date fixed by the court below.

Accordingly, this application is dismissed.
