29-04-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with Bisfi P.S. Case No. 83/2013 registered for the offences punishable under Sections 379 of the Indian Penal Code and Section 135 of the Electricity Act.
Learned counsel for the petitioner submits that the alleged search and seizure of items as stated in the seizure-list annexed to the First Information Report, does not indicate as to whether any witness was given a copy of the same or was present at the time of seizure. He also submits that in fact the village in question has no electricity and, therefore, the question of electricity theft would not arise.

No.46617 of 2014 (2) dt.29-04-2015 2/2 Considering the aforementioned submissions and also the fact the at the petitioner has no criminal antecedent let the petitioner, in the event of his arrest / surrender within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Madhubani in connection with Bisfi P.S. Case No. 83/2013 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
