ANJANA PRAKASH ORAL JUDGMENT Date: 04-12-2015 The petitioner seeks cancellation of bail granted to the private opposite party by order dated 20.06.2015 by the Additional Sessions Judge, Xth, Patna in A.B.P. No. 380 of 2015 arising out of Gardanibagh P.S. Case No. 04 of 2015.
It has been submitted on behalf of the petitioner that the private Opposite Party no. 2 had suppressed the fact in court below 1 that he had criminal antecedent and on consideration he had been granted bail.
Counsel for the O.P. No. 2 submits that there is no consideration with regard to the antecedent of the petitioner at all in the entire order and therefore, even if a bonafide mistake had been committed it has no bearing on the final order.
Patna High Court Cr.Misc. No.40440 of 2015 dt.04-12-2015 2/2 Having considered this fact that no doubt the O.P. No. 2 has committed a wrong for which he is warned to be careful in future and the same reason is not enough to cancel his bail bonds. With the aforesaid observations the application stands disposed off.
