Petitioner apprehends arrest in Sarmera Police Station Case No 99 of 2016 registered under Sections 420, 467, 468, 414, 120B of Indian Penal Code.
Learned counsel for the petitioner submits that the alleged stolen Hero Honda Splender motorcycle was recovered from the possession of his son. Merely, upon the statement of his son, he has been implicated in this case. The papers, in respect of the motorcycle produced by the son, also do not tally with the engine and chassis number of the recovered motorcycle. Merely on the basis of apprehension of such recovery, the police has alleged that the petitioner used to
Patna High Court Cr.Misc. No.65554 of 2018(2) dt.13-12-2018 2/2 prepare fake and forged papers in respect of stolen motorcycle. There is one case in which the petitioner was made accused long back being Sarmera Police Station Case No 70 of 2004 in which case, he is on bail.
Considering the aforesaid circumstances, prayer for anticipatory bail is allowed. In the event of his arrest or surrender before the Court within four weeks from today, the petitioner above named shall be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in Sarmera Police Station Case No 99 of 2016 subject to all conditions as laid down in Section 438 (2) of Criminal Procedure Code.
