2. The petitioner preferred this application for grant of regular bail in connection with Sessions Trial No. 331/2023 arising out of Kajra P.S. Case No. 73 of 2023 dated 30.05.2023 registered for the offences punishable u/ss 302, 201, 120B of the Indian Penal Code and Section 25(1-B)a, 26 and 27 of the Arms Act.

As per the prosecution case, the petitioner who is the husband of the deceased in connivance with his adopted son, namely, Sourav Kumar and his sister-in-law namely, Sudha Shree shot his wife dead on account of love affair with Sudha Shree while his wife was sleeping and he hid the pistol and cartridge in a room. Thereafter, the petitioner was handing over the same to his son Sourav Kumar then police saw and caught him.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner has surfaced in this case merely

Patna High Court CR. MISC. No.20579 of 2025(2) dt.18-06-2025 2/2 on suspicion. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner are in custody since 31.05.2023 and he has no illicit relationship with Sudha Shree.

Learned A.P.P. for the State has opposed the bail petition of the petitioner and submitted that the specific allegation is against the petitioner who shot his wife dead on account of love affair with Sudha Shree. It is further submitted that earlier the bail application of the petitioner has been rejected by this court vide order dated 13.12.2024 passed in Cr. Misc. No. 87337/2024.

Considering the aforesaid facts and circumstances of the case as well as the Specific and heinous nature of allegation against the petitioner, this Court is not inclined to grant bail to the petitioner and the same is rejected in connection with Sessions Trial No. 331/2023 arising out of Kajra P.S. Case No. 73 of 2023, pending in the court of learned Additional District and Sessions Judge-III, Lakhisarai.

7. Learned trial court is directed to expedite the trial and conclude the same at the earliest.
