Case No.158 of 2011 registered for the offences punishable under Sections 302, 201 read with Section 34 of the Indian Penal Code, which is pending in the court of the learned A.C.J.M., Rosera at Samastipur.

Apprehending arrest, the petitioner filed A.B.P(R) No.93 of 2012 in the court of Additional District & Sessions Judge, Rosera, District-Samastipur. The same was dismissed on 7.3.2013. Hence, this application for grant of anticipatory bail under Section 438 of Cr.P.C.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

The allegation against the petitioner is serious in nature.

Patna High Court Cr.Misc. No.14117 of 2013 (3) dt.01-04-2015 2/2 It is in relation to the death of her sister-in-law, the husband of the petitioner was arrested and he was granted bail. Considering the nature of allegation, this Court is not inclined to grant bail to the petitioner. This application on her behalf is dismissed.

However, the petitioner may surrender before the concerned court and apply for bail. In case the petitioner surrenders in connection with Bibhutipur P.S. Case No.158 of 2011 before the trial court and prays for regular bail, her application for regular bail shall be considered and disposed of expeditiously.
