JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-04-2024 The present writ has been filed seeking the following reliefs:- "1(a). For issuance of writ in the nature of MANDAMUS directing the respondent authorities preferably Respondent no.-2 to ensure the payment of salary and other allowances admissible under law qua the suspension period i.e. 21.02.2018 to 19.01.2021 minus the subsistence allowance already paid and salary for the period commencing from date of dismissal to date of reinstatement i.e. 20.01.2021 to 10.05.2023 along with interests of salary and allowances in respect of the period of suspension, in accordance with, the order of reinstatement, dated 04.03.2023 (Annexure -P/4), treating the said period of suspension as period spent on duty.

For issuance of writ in the nature of MANDAMUS directing the respondent authorities to extend the number of installments from 24 to 60 for payment of penalty of Rs. 25,38,719/- as condition imposed by the Respondent No.-2 while reinstating the petitioner vide its order dated 04.03.2023 passed in Service Appeal No.- 08/2021."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Commissioner, Darbhanga Division, Darbhanga, for redressal of his aforesaid grievances. Liberty, so sought, is granted. 3.

It is needless to state that in case, the petitioner approaches the Commissioner, Darbhanga Division, Darbhanga, by filing appropriate representation, within a period of two weeks from today, the same shall be disposed off, by a reasoned and a speaking order, in accordance with law, within a period of six weeks, thereafter.

The writ petition stands disposed off on the aforesaid terms.
