2. The petitioner is apprehending his arrest in connection with Obra P.S. Case No. 243 of 2018 for the offence under Sections 30(a)/30(b)/30(D) of the Bihar Prohibition and Excise (Amendment) Act, lodged on 09.11.2018 by the informant, Brajesh Kumar.

3. As per the prosecution story, the informant alleged that on information, the police raided the place and on the field there is recovery of 2.5 quintals Jawa Mahua beside 27 litres country made wine, which lead to F.I.R.

4. Learned counsel for the petitioner submits that as per seizure list, the recovery is made from the open place cannot be attributed to the petitioner.

5. Learned APP on the other hand opposes the prayer

Patna High Court CR. MISC. No.20381 of 2025(2) dt.30-04-2025 2/2 for bail and submits that the petitioner has four criminal antecedent of similar nature.

6. Considering the submission of the parties, coupled with the fact that the petitioner has four criminal antecedents of same nature, this is not a fit case for grant of anticipatory bail to the petitioner.

7. The application of anticipatory bail stands rejected.

8. However, if the petitioner surrender within a period of four weeks, the court concerned shall take up the matter and dispose it of preferably on the same day.
