This application is for grant of bail in connection with Gogri P.S.Case No.32 of 2015 for the offence under Sections 324 and 307/34 of the Indian Penal Code.
It is submitted on behalf of the petitioner that the injured is himself a criminal and it appears that the occurrence took place in some other manner and the petitioner is not accused in this case, which will appear from the fact that the fardbeyan has been recorded on 26.01.2015, at that time, he was in Paras HMRI Hospital, Patna. He is in custody since 30.04.2015. Heard learned A.P.P. also, who has opposed the prayer for bail stating that there is direct allegation against the petitioner. Having heard both sides. Patna High Court Cr.Misc. No.53184 of 2016 (4) dt.08-02-2017 2/2 am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial. If the trial is not concluded within a period of nine months, the petitioner is at liberty to move for bail.
