The petitioner seeks regular bail in connection with Gangabridge P.S. Case No. 76 of 2018 for the offences punishable under Section 30(A) of Bihar Prohibition and Excise Act, 2016.

The allegation of the prosecution is that when the police had conducted raid in the hut of the accused persons, 1816 litres of illicit liquor was recovered and while several accused persons had managed to flee away, one of the accused persons was caught at the spot and he named all the other accused persons including the petitioner herein and subsequently the petitioner was apprehended.

No.70528 of 2018(2) dt.12-12-2018 2/2 The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case inasmuch as the petitioner was not apprehended from the spot and it is stated that he was apprehended subsequently on mere suspicion. It is state that the petitioner is having clean antecedent and he is in custody since 18.08.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IInd cum Special Judge, Excise, Hajipur at Vaishali in connection with Gangabridge P.S. Case No. 76 of 2018.
