2. The present application has been filed by the petitioner for restoration of Cr. Appeal (SJ) No. 137 of 2025 which was dismissed for non-compliance of the order dated 18.01.2025 wherein two weeks peremptory time was granted for taking steps for service of notice upon the respondent no.2 under both modes i.e. under ordinary process and registered cover with A/d.

3. Learned counsel for the petitioner submits that due to inadvertence, the notice to the respondent no.2 was not sent

Patna High Court CR. MISC. No.21512 of 2025(2) dt.04-04-2025 2/2 within the prescribed period of two weeks from the date of the order i.e. 18.01.2025.

4. For the reasons stated in this restoration application and the submissions made in support thereof, the present restoration petition is allowed and, as a consequence, the Cr. Appeal (SJ) No. 137 of 2025 stands restored to its original file.

5. The petition stands allowed.
