Petitioner apprehends his arrest in connection with Excise Case No. 307 of 2006 registered under Section 47A of the Excise Act.
Learned counsel for the petitioner submits that petitioner had no information nor any notice was ever served upon him about the fact that he has been made accused in the present case. Seizure list was not served either on the petitioner or his family members. Nothing has been recovered from the possession of the petitioner.
Considering the facts and circumstances of the
Patna High Court Cr.Misc. No.8402 of 2017 (2) dt.08-03-2017 2/2 case, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri P.K. Pandey, Judicial Magistrate, 1st Class, Gaya in connection with Excise Case No. 307 of 2006 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
