====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 02-04-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in a case for the offence registered under Sections 419, 420, 120(B) and 504 of the IPC.

The prosecution story, in brief, is that the informant had purchased a piece of land from Milan Devi, wife of Satyendra Kumar Singh, on 06.05.2016 and on the said deed, Sampat Singh (petitioner) has put his signature as a witness and a case is going on the aforesaid land and in connivance with the accused persons the informant has been cheated and there is specific allegation against Satyendra Singh. He is main conspirator in the entire episode.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent.

The petitioner has been made accused in the present case due to mistake of fact. The petitioner is alleged to be witness on the sale deed. There is no wrongful gain made on the part of the petitioner nor any wrongful loss has been caused to the informant by the petitioner. The matter relates to civil dispute.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R/ complaint case.

Considering the aforesaid facts and circumstances, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Ara, in connection with Ara Nagar P.S. Case No. 523 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
